</span><span style="font-family:Verdana;font-size:x-small;">UNITED NATIONS, Jan 14, 2010 (IPS) &#8211; Millions of people around the world who belong to indigenous communities continue to face discrimination and abuse at the hands of authorities and private business concerns, says a new U.N. report released here Thursday.</span><span style="font-family:Verdana;"><br />
</span><span style="font-family:Verdana;"><br />
</span><span style="font-family:Verdana;font-size:x-small;">It is happening not only in the developing parts of the world but also in countries such as the United States, Canada, Australia and New Zealand, which champion the causes of human rights and democracy, the report says.</span><span style="font-family:Verdana;"><br />
</span><span style="font-family:Verdana;"><br />
</span><span style="font-family:Verdana;font-size:x-small;">Despite all the &#8220;positive developments&#8221; in international human rights setting in recent years, the study&#8217;s findings suggest that indigenous peoples remain vulnerable to state-sponsored violence and brutality, which is often aimed at confiscating their lands.</span><span style="font-family:Verdana;"><br />

</span><span style="font-family:Verdana;font-size:x-small;">&#8220;Governments and the United Nations need to be serious about this,&#8221; said Victoria Tauli-Corpus, chairperson of the U.N. Permanent Forum on Indigenous Issues, an advisory body that works with the 54-member Economic and Social Council, after launching the report.</span><span style="font-family:Verdana;"><br />

</span><span style="font-family:Verdana;font-size:x-small;">The 222 page-report, entitled &#8220;State of the World&#8217;s Indigenous Peoples&#8221;, points out that an overwhelming majority of the indigenous population is condemned to live in extreme poverty. Its authors noted that while indigenous peoples are around five percent of the world&#8217;s population, they comprise 15 percent of people living in extreme poverty.</span><span style="font-family:Verdana;"><br />

</span><span style="font-family:Verdana;font-size:x-small;">The first-ever comprehensive report on indigenous peoples&#8217; rights comes as the U.N. is reviewing progress toward achieving the Millennium Development Goals (MDGs), globally agreed targets to reduce, poverty, disease and environmental destruction, among other issues, by the year 2015.</span><span style="font-family:Verdana;"><br />

</span><span style="font-family:Verdana;font-size:x-small;">Explaining her findings, one of the report&#8217;s authors, Myrna Cunningham, said indigenous communities in many countries are living in abject poverty because they have lost their lands to private interests that are often backed by state authorities.</span><span style="font-family:Verdana;"><br />

</span><span style="font-family:Verdana;font-size:x-small;">She also raised concerns about the extrajudicial killing of indigenous people in some parts of the world. In this context, she cited the examples of Colombia and Peru, where extreme hostility towards native people has been well-documented by human rights organisations.</span><span style="font-family:Verdana;"><br />

</span><span style="font-family:Verdana;font-size:x-small;">&#8220;There are several cases where indigenous peoples are being identified by governments as terrorists,&#8221; Cunningham told IPS, adding that it was in clear violation of the U.N. Declaration on the Rights of Indigenous Peoples.</span><span style="font-family:Verdana;"><br />

</span><span style="font-family:Verdana;font-size:x-small;">The U.N. Declaration was adopted by the General Assembly in 2007. The historic document calls for the recognition of native populations&#8217; right to control their lands and protect their culture and language.</span><span style="font-family:Verdana;"><br />

</span><span style="font-family:Verdana;font-size:x-small;">The report&#8217;s chapter dealing with environmental issues suggests that most of the deforestation is taking place on indigenous territories due to massive operations by mining corporations. It says many of the business ventures on native lands are illegal.</span><span style="font-family:Verdana;"><br />

</span><span style="font-family:Verdana;font-size:x-small;">&#8220;We have agonised over many ongoing situations,&#8221; said Ben Powless, an indigenous activist in Canada who has attended numerous international meetings on climate change and biodiversity, including the U.N. summit held in Copenhagen, Denmark last month.</span><span style="font-family:Verdana;"><br />

</span><span style="font-family:Verdana;font-size:x-small;">Powless said those situations included &#8220;the massacres of our relatives in the Peruvian Amazon, the evictions of our Masai families in Kenya, and the devastation of our communities by the impacts of climate change.&#8221;</span><span style="font-family:Verdana;"><br />

</span><span style="font-family:Verdana;font-size:x-small;">Large dams and mining activities have caused massive displacements of indigenous peoples in many countries. The study&#8217;s authors documented several cases where native people were forced by the tourism industry to leave their ancestral lands.</span><span style="font-family:Verdana;"><br />

</span><span style="font-family:Verdana;font-size:x-small;">The report points out that in many countries around the world, indigenous children are not only deprived of education, but also lack adequate access to health care and nutritious food.</span><span style="font-family:Verdana;"><br />

</span><span style="font-family:Verdana;font-size:x-small;">That, according to Cunningham, is against &#8220;our right to self-determination&#8221;.</span><span style="font-family:Verdana;"><br />

</span><span style="font-family:Verdana;font-size:x-small;">The U.N. General Assembly fully recognises indigenous populations&#8217; right to exercise their right to &#8220;self-determination&#8221;. However, some powerful countries, including the United States and Canada, have rejected the Declaration.</span><span style="font-family:Verdana;"><br />

</span><span style="font-family:Verdana;font-size:x-small;">Contrary to the previous U.S. administration&#8217;s stance, President Barack Obama seems willing to sign on to the declaration. ¨We are having a dialogue with the U.S. government,&#8221; Tauli-Corpus told IPS. &#8220;We are doing all we can.&#8221;</span><span style="font-family:Verdana;"><br />

</span><span style="font-family:Verdana;font-size:x-small;">At the news conference, Tauli-Corpus raised hopes that at future talks on climate change, indigenous peoples&#8217; rights to control their lands and forests will be given due consideration. But not all indigenous leaders think along the same lines.</span><span style="font-family:Verdana;"><br />

</span><span style="font-family:Verdana;font-size:x-small;">Recent negotiations on climate change have suggested that deforestation in indigenous lands could be tackled by means of carbon trading. Many indigenous peoples see that as a tool of corruption and a threat to their cultural survival.</span><span style="font-family:Verdana;"><br />

</span><span style="font-family:Verdana;font-size:x-small;">&#8220;Carbon trading and carbon offsets are a crime against humanity and Creation,&#8221; said Tom Goldtooth, executive director of the Indigenous Environmental Network. &#8220;The sky is sacred.&#8221;</span><span style="font-family:Verdana;"><br />

</span><span style="font-family:Verdana;font-size:x-small;">&#8220;This carbon market insanity privatises the air and sells it to climate criminals like Shell so they can continue to pollute and destroy the climate and our future, rather than reducing their emissions at source,&#8221; he added in a statement.</span><span style="font-family:Verdana;"><br />

</span><span style="font-family:Verdana;font-size:x-small;">Considering the fact that much of the world&#8217;s forests are located in indigenous peoples&#8217; lands, Goldtooth fears that carbon trading would pave the way for more &#8220;land grabs, killings, evictions and forced displacement&#8221; of native communities.</span><span style="font-family:Verdana;"><br />

<p>De una manera inconsulta, arbitraria llegaron el día sábado 19 de julio del presente año en tres vehículos blindados y un Helicóptero los altos funcionarios de Petroproducción y escoltados por la inteligencia militar; pretendiendo engañar a la población y autorizando explotar petróleo, yéndose por encima de un conglomerado de ACIA que plantea NO A LA EXPLOTACION PETROLERA EN EL TERRITORIO DE BOSQUE DEL OGLAN ALTO- SHUAR WASHENTS que son Territorios de la Asociación de Comunidades Indígenas de Arajuno “ACIA”, la decisión histórica que ha tomado el pueblo kichwa y Shuar de Arajuno ha sido y será RECHAZAR Y VIGILAR CUALQUIER INTENTO DE INTROMISIÓN DE ELEMENTOS (PERSONAS, HERRAMIENTAS Y MAQUINARIAS) a ese lugar. Es el momento de parar el abuso y la prepotencia en las que incluso ha minimizado a los Pueblos y Nacionalidades como si fuéramos actores reducidos de la sociedad Ecuatoriana.</p>

Juan Chiriboga Pinos Sub Gerente de operaciones de PETROPRODUCCIÓN; este Territorio es declarado como Área de Bosque y vegetación Protectores con el acuerdo Nº 136 del ministerio del Ambiente, mediante Registro oficial Nº 24 del 24 de mayo del 2005.</p>

<p>Arbitrarily and without consultation, on Saturday 19th July of this year the top officials of Petroproducción arrived in three armoured vehicles and a helicopter, escorted by military intelligence, hoping to trick the population and authorising oil production, going over the heads of a conglomerate of ACIA which says NO TO OIL EXPLOITATION IN THE FOREST TERRITORY OF OGLAN ALTO-SHUAR WASHENTS, which are territories of the Association of Arajuno Communities “ACIA”.  The historic decision taken by the Kichwa and Shuar people of Arajuno has been and shall be TO REJECT AND WATCH OUT FOR ANY ATTEMPT TO INTRODUCE ANYTHING (PERSONS, TOOLS AND MACHINERY) to this place.  It is time to stop the abuse and arrogance by which the Peoples and Nations of Ecuador have been downgraded as if we were second-class members of Ecuadorian society.<br />

<p>THREAT OF GENOCIDE OF INDIGENOUS COMMUNITIES IN CAUCA, COLOMBIA</p>
<p>The Regional Indigenous Council of Cauca department, South-West Colombia (CRIC), publicly denounces the threat which arrived to the North of Cauca section on 11th August by email, announcing the genocide of Colombia’s indigenous populations, and perversely inferring the government’s strategy to destabalize the unity of indigenous, afro-Colombian and campesino (poor farmer) communities in the department.</p>
<p>It is no secret that President Alvaro Uribe Velez has declared war on indigenous communities which have decided to demand their rights. A determining moment came in March 2008, during a speech in Popayan, the capital of the Cauca department, when Uribe offered to reward those who helped to break the unity of the indigenous community [by informing on the leaders of the ‘liberation of the madre tierra’ process, in which indigenous populations are reclaiming ancestral land to which they are entitled by the 1991 political constitution]. Added to this, institutional spokesperson have consistently reiterated the message that the indigenous population benefts from state guarantees to the detriment of the rights of other sectors of society. One example was the purchase of the Villa Carola farm by the Ministry of the Interior in order to award it to displaced people, when the farm had been promised to the Kononuko indigenous community since the 1980’s.</p>
<p>The text, which covers itself by claiming to be from an anti-indigenous campesino group, reproduces the same discourse used by the national government with the aim of blaming the indigenous population for the failure of land policies and the lack of agrarian reform in Colombia [text below in Spanish original].<br />
<span id="more-227"></span><br />
It refers to the CRIC as ringleaders and guerrillas, and states that from this day forward (11th August) they will be found dead and disappeared, states its wish that the cities of Popayan, Cali and Bogota are free of indigenous people and that they will not allow the indigenous population to pass 1 million in Colombia [there are 1.4 million according to the 2005 census].</p>
<p>Clearly showing the paramilitary essence of the threat, the authors say that they have the indigenous population surrounded by intelligence members of their group, and have prepared teams and logistics support. The call for a process of military occupation and extermination against CRIC members and the paece indigenous population of Cauca. To justify this they refer to comments by the commander of the Third Brigade of the Colombian Army, in which he alleged links between the 6th front of the FARC and officials from the administration of Toribio municipality.</p>
<p>Later in the document, to try and hide their paramilitary identity, they again identify themselves as anti-indigenous campesinos.</p>
<p>It is alarming that the communication defends institutions using a tone of terrorist threat, expressing hate for Cauca’s indigenous population using institutional phrases, showing that the nazi paramilitary armies haven’t been relinquished by the President of the Republic nor by the organisms of state control.</p>
<p>The majority of the arguments used to discredit the indigenous population are the same ones which have been generated by political sectors in recent years, driving racial discrimination and the war against indigenous communities, and opposing any agrarian reform.</p>
<p>Claiming to speak on behalf of non-indigenous rural sectors but in reality defending inequality, plundering and displacement of indigenous, campesino and afro-Colombian communities from their territories, similar arguments were used by landowners in the north of Cauca depàrtment days before the Nilo massacre in December 1991. According to the confessions of paramilitary Hernando Villa Zapata, this massacre was planned in the La Emperatiz farm. Current government viceminister Maria Isabel Nieto says that this farm cannot be handed over to victims as it wouldn’t be administrated suitably, placing the victims rights to truth, justice and reparation far below those of big business.</p>
<p>We call on social organizations, democratic sectors, human rights organisms and the international community to denounce this threatened genocide which has already started over the last few years. We call on the national government to respond according to it’s constitutional obligations and international human and peoples’ rights agreements.</p>

<p>ACCIÓN URGENTE</p>
<p>AMENAZA DE GENOCIDIO A PUEBLOS INDÍGENAS DEL CAUCA Y COLOMBIA</p>
<p>El Consejo Regional Indígena del Cauca alerta frente a la amenaza que llegó, vía correo electrónico a la Asociación de Cabildos del Norte del Cauca, en la noche del 11 de agosto, anunciando el genocidio de las poblaciones indígenas de Colombia y concluyendo, de forma perversa, con el enunciado de la estrategia que viene haciendo el gobierno nacional para desestabilizar la unidad de las poblaciones campesinas, afros e indígenas de este departamento.</p>
<p>Para nadie es un secreto que desde la presidencia de la república se ha declarado la guerra a los pueblos indígenas que decidan reclamar sus derechos. Un momento determinante fue el consejo comunitario realizado en la ciudad de Popayán en el mes de marzo del 2008, donde Uribe dio la orden de pagar recompensas para romper la unidad de las comunidades indígenas. Unido a ello de forma continua los voceros institucionales se han preocupado por entregar mensajes indicando que los indígenas son beneficiarios de las garantías del Estado en detrimento de los derechos de los demás sectores de la sociedad. Un ejemplo fue la compra de la finca Villa Carola realizada por el ministerio del interior para entregarla a los desplazados, cuando dicho predio ha estado comprometido desde la década de los ochenta para los indígenas Kokonuko de Poblazón.</p>
<p>El texto, que se encubre en la identidad campesina, reproduce el discurso que el gobierno nacional ha venido promulgando desde las voces institucionales, con el objetivo de responsabilizar a los indígenas del fracaso de la política de tierras y de ser los causantes de la ausencia de una reforma agraria en Colombia.</p>
<p>Plantea que los indígenas paeces e integrante del CRIC, a quienes señala de cabecillas y guerrilleros, serán encontrados muertos y desaparecidos a partir del día de hoy, y que quieren a Popayán, Cali y Bogotá libre de indios ya que, según ellos, en Colombia no sobrepasamos el número de un millón.</p>
<p>Descubriendo claramente su esencia paramilitar, los autores del panfleto, informan que los indígenas se encuentran rodeados de miembros de inteligencia de dicho grupo, el cual cuenta con logística  y equipos preparados. Llaman a un proceso de ocupación militar y exterminio contra los integrantes del CRIC y los paeces del Cauca. Para justificar ello se basan en acusaciones como la del comandante de la tercera brigada del ejército, al cual citan en su señalamiento de nexos de funcionarios de la alcaldía de Toribío y el sexto frente de la guerrilla de las farc.</p>
<p>Mas adelante, para ocultar su esencia paramilitar, vuelven a identificarse como campesinos antiindios, se autodenominan campesinos embejucados de Colombia.</p>
<p>Alarma que un comunicado de defensa a la institucionalidad, en un tono de amenaza terrorista, que argumenta su odio en frases institucionales contra los pueblos indígenas del Cauca y que está acompañado de fotografías que muestran a los ejércitos nazis no haya sido repudiado ya por la presidencia de la República ni por los por los organismo de control del Estado.</p>
<p>La mayoría de los argumentos para descalificar a los indígenas son los mismos que durante los últimos años han venido generando sectores políticos y gremiales que impulsan la discriminación racial y la guerra contra las comunidades indígenas, y que se oponen a cualquier intento de reforma agraria.</p>
<p>Pretextando hablar en nombre de sectores rurales no indígenas, en realidad defienden la inequidad, el despojo y el desplazamiento de indígenas, campesinos y afro colombianos de sus territorios; argumentos como los anteriores fueron usados por los terratenientes del norte del Cauca, días antes de la masacre del Nilo, en diciembre de 1991, la cual fue planeada en  la Finca La Emperatríz según las confesiones del paramilitar Hernando Villa Zapata.  Finca que hoy la viceministra María Isabel Nieto dice que no se puede entregar a las víctimas por estar eficientemente administrada; colocando el derecho a la verdad, justicia y reparación muy por debajo de los intereses del gran capital.</p>
<p>Llamamos a las organizaciones sociales, a los sectores demócratas, a los organismos de derechos humanos y a la comunidad internacional para que este genocidio anunciado, y que se viene perpetrando en los últimos años, sea detenido; y al gobierno nacional a que responda acorde con sus obligaciones constitucionales y los tratados internacionales de derechos humanos y derechos de los pueblos.</p>

CAMPESINOS EMBEJUCAOS –</p>
<p>En estos últimos años el CRIC ordena la toma de tierras en distintas partes del Cauca, tierras que a nosotros los Campesinos nos obligan a vender en contra de la voluntad, cuando solo lo que hacemos es producir el pan coger, comida y empleo, este propósito se está dando en medio de las peores amenazas y hostigaciones patrocinadas por los asesores y cabecillas del cric, donde dicen que el territorio es de ellos y que allí no caben ni los mismos indios, campesinos, ni negros, que ese espacio es de los paHECES, cuando entendemos que estas amenazas, amedrentamientos, y hechos de ocupaciones sedan entre los mismos pobres, en medio de las condiciones de pobreza, en una de las zonas más violentas y conflictivas del cauca, como lo es Caldono, Santander, Piendamo, Cajibio, Jámbalo, Totoro.<br />
Zonas donde habitan entre indios, negros, mulatos, mestizos, pero un 99% habitan seres humanos humildes, pobres, excluidos por el sistema estatal y explotados por el gran capital, que hoy se ha tomado esta región del país, nosotros los campesinos embejucaos no solo vivimos de la persecución estatal sino también de la persecución del cric y sus cabildos, que nos ponen en una situación muy difícil de nuestras familias en nuestras propiedades y minifincas con la que hemos sobrevivido siempre.<br />
La persecución del CRIC y cabildos paHECES que no solo permiten trabajar, y vivir, sino que llenan de zozobra, aterrorizan confunden nuestras familias y niños, por que como ellos mismos dicen son terroristas de campesinos, negros, mestizos y mulatos, y hasta entre los mismos indios se persiguen, se acosan, hasta se matan y se roban los alimentos y semovientes a través de sus guardias y cabildos, que no sabemos si son guerrillas, o paramilitares, o delincuentes patrocinados por el CRIC, porque su propósito es desplazar a campesinos y lo más triste es ver que entre ellos mismos no se aceptan, y se amenazan y se han matado, los paHECES creen que el Cauca, Valle, Tolima, Huila y Putumayo es de ellos, eso es lo que hace el CRIC   (Combo de Revoltosos Incitadores de la CXenofia)<br />
Hoy debemos ALZARNOS para detener a los opresores o nos quedamos sin futuro. Señalamos el “problema de fondo” que nos amenaza para anunciar un camino que ya empezamos a recorrer y al que convocamos para que juntos todos caminemos para defendernos del CRIC y paHECES, ellos hablan de liberar la Madre Tierra, la preocupación de los campesinos del Valle, Cauca y Huila es que tenemos que defendernos de las agresiones y xenofobia y hay muchas formas desde la militar por que ya sabemos quiénes son, donde están y que hacen.<br />
Para nosotros los campesinos el panorama en el Cauca, Valle y Huila es realmente desolador, fuera del abandono del estado, la capacidad de organizarnos para atender las necesidades de acceso al servicio de agua, acueducto que también nos mezquinan los Indios y especialmente los paHECES  la respuesta del gobierno nacional ante estas circunstancias debe ser es búsqueda de una solución pública  o clandestina porque no soportamos mas.</p>
<p>En Colombia, creíamos que los indios iban a dar una lucha que alguna vez buscarían algún equilibrio entre los pobladores, en los últimos años se ha quebrado a favor de la imposición del CRIC que según sus actos son iguales a los de las la guerrilla han perdido toda posibilidad de negociar acuerdos humanitarios en condiciones favorables para todos los pobladores del campo y hasta entre los mismos indios, no podemos aceptar ni mantenernos agachados ante las agresiones, ofensivas y políticas mezquinas de los paHECES y que  hoy sufren y enfrentan un agudo y grave descrédito entre la población del Cauca, Colombia y el Mundo</p>
<p>Ya sabemos de sus aliados significativos en la región, aún así, lo más cierto es que las FARC sigan adelante, con su menguada capacidad de iniciativas y con la probable fragmentación entre sus mandos y frentes como el CRIC y paHECES, preparan militarmente en el ejercito a sus jóvenes para entregarlos a las FARC.</p>
<p>“Celebremos la liberación, y no aceptar el régimen del CRIC y paHECES”</p>
<p>Hay que decirlo con claridad: se instaura una dictadura del CRIC-paHECES en el Cauca y Valle del Cauca en Colombia. El CRIC juzga, condena y ordena las ocupaciones, desalojos de campesinos pobres, ignorantes como su misma raza, y hasta entre los mismos indios que a futuro serán nuestros aliados.</p>
<p>No se requiere nada más que su palabra para comenzar este desafío y condenar a sus responsables. No somos culpables que estemos en Colombia, los cargos que hace el CRIC y paHECES de ocupar terratenientes son falsos porque no tenemos cinco mil hectáreas como  lo tiene Uribe Vélez.</p>
<p>Pero no parece importar, porque con su reputación ha reemplazado su ilegitimidad. El aparato del CRIC y Cabildos paHECES, desde hace años, es utilizado como un arma contra el pueblo Caucano, en particular contra los pobres (creados en gran medida desde el mismo) y contra quienes se organizan o denuncian o resisten.</p>
<p>La evidencia y los testimonios, se ocultan por orden de los propios incriminados. Los testigos desaparecen porque son sobornados, se compran, se asesinan. Los altos mandos del CRIC que son Doctores justifican pretensiones de civiles y mienten.</p>
<p>En medio de esto, debemos alzarnos para ver quien resiste más. Si no resistimos, si no nos alzamos si no los detenemos, nos sacaran de estas tierras y del planeta a costa de zozobra, fuerza, hambre y mentiras ordenados por los funcionarios del CRIC, guardias entrenados militarmente para la guerra  de terror y de Cabildos ilegítimos se instala en el poder para convertir la vida en su ganancia y destruir a los demás.</p>
<p>Ellos denuncia la Gravísima Situación de Guerra en el Norte del Cauca pero el terror, amedrentamiento, zozobra, corrupción, holgazanería, delincuencia, prostitución dentro de las mismas oficinas del CRIC, abigeato, quemas y demás daños que comenten contra los campesinos lo ocultan.</p>
<p>Hacen llamados a la opinión Publica URGENTE de ASESINATOS DE COMUNEROS DE TACUEYÒ, FUERTES COMBATES EN “LA COMUNIDAD” RESGUARDO DE TACUEYÓ</p>
<p>HACEMOS UN LLAMADO A LA PRUDENCIA Y AL RESPETO POR LA VIDA DE LA POBLACIÓN CIVIL. Cual llamado, Cual Prudencia, cual Respeto por la VIDA de la población de campesinos pobres del Cauca?</p>
<p>&lt;!&#8211;Ahora si vamos a hacer noticia, y también diremos que siendo aproximadamente las 00:00 de esta Noche, recibirán información sobre la muerte de paHECES y cabecillas exguerrilleros del CRIC por campesinos, lo que les será confirmado Telefónicamente a causa de su irrespeto.</p>
<p>&lt;!&#8211;No se quejen cuando el CRIC y paHECES, serán encontrados muertos y un significativo número de miembros de ustedes desaparecidos, Sabemos que en Colombia ustedes no sobrepasan el Millón de personas en Colombia.</p>
<p>Queremos de Popayán, Cali y Bogotá Libre de Indios porque allí están la guarida y concentración de los cabecillas.</p>
<p>3 Sus Guaridas se encuentra rodeadas de miembros de inteligencia nuestra y otros paHECES es decir su  propia gente que nos dan información para poder defendernos, tenemos nuestros equipos, logística y equipos preparados.</p>
<p>&lt;!&#8211;Así como nos desvelaron ustedes, también tendrán la oportunidad de sentir lo bueno del desvelo, la zozobra y la incertidumbre después de todas estas noches.</p>

<p>Debemos avanzar en un proceso de ocupación militar y exterminio contra las Cabecillas del CRIC y paHECES del Cauca. Porque ellos nos agreden con declaraciones falsas y criminales, lo mismo que tienen infiltración de armados (QUINTIN) son parte de sectas que presionan con iniciativas irrespetuosas orientadas al despojo y entrega de tierras para los cabildos.</p>
<p>No tenemos más alternativa que defender la vida y convocar a la humanidad para que no permita que se extinga nuestra tranquilidad y ganas de vivir, porque también tenemos derechos, derechos no solo lo tienen los indios. También somos patrimonio de vida. Los criminales del despojo, desalojo, amedrentamiento y la muerte son ustedes…el CRIC paHECES que hacen y deshacen, ordenan las acciones de despojo, mienten y matan para acumular, también merecen ser castigados por nuestra justicia, porque también merecemos la vida y nuestra tranquilidad.</p>
<p>Las acusaciones que realizo el comandante de la tercera brigada del ejército nacional, el general Jaime Esguerra a través de un noticiero, el cual dice de manera textual y  “asegura que en documentos que él posee, demostrarían nexos entre los funcionarios de la alcaldía de Toribio y el sexto frente de las FARC”. Cuando el rio suena es porque piedras lleva.</p>
<p>El CRIC y paHECES que reclaman? Por el derecho a la Vida, la dignidad y la convivencia Pacífica cuando al campesinado no nos dejan vivir tranquilos?</p>
<p>Ellos dicen que con Falsas y Graves Acusaciones quieren Exterminar los Procesos de Resistencia, nosotros los campesinos tampoco resistimos los abusos del CRIC y paHECES</p>
<p>-El -1) El gobierno les da plata para que hagan fechorías?  Con sus farsas de procesos comunitarios proyectan solo Planes de envidias, dizque por el camino de la autodeterminación como pueblos para dominar y asustar a los tontos?.</p>
<p>&lt;!&#8211;2)El gobierno asigna dineros  para que renten sus comunidades y no las gasten en Popayán  organizando fechorías  justificando el movimiento cívico, realizado diagnósticos, planeando  claras políticas de no convivencia  de corto mediano y largo plazo, de destierro de campesinos y negros,  de esta manera igualmente se distribuye las transferencias de la Nación, en asambleas donde participan gentes y delegados de las veredas del Cauca a comer y emborracharse a costa de los demás indios ignorantes.</p>
<p>&lt;!&#8211;3)   Quieren hacer creer a los gobiernos que los funcionarios del CRIC son personas idóneas elegidas mediante asambleas públicas y en caso de cometer faltas son sancionados por asambleas comunitarias de acuerdo usos y costumbres eso es falso porque son unas ratas, que viven solo de ese medio (Alcibíades).</p>
<p>&lt;!&#8211;4)El CRIC y los paHECES  hablan de procesos transparentes que la comunidad fiscaliza mediante sus asambleas evaluativas y veedurías comunitarias, y que por eso se ha resaltado el trabajo de este proceso que ha recibido reconocimientos nacionales e internacionales, eso es mentira, porque también vende tierra igual que nosotros los campesinos, y quieren hacer creer por fuera del país que han hecho mucho, con tanta plata que han recibido donde está el desarrollo?.</p>
<p>&lt;!&#8211;5)   Que la organización indígena en reiteradas ocasiones se ha manifestado públicamente de no compartir la salida del conflicto por la vía armada y frente a este se ha asumido la posición crítica y constructiva en defensa de la vida mediante mecanismos humanitarios lo cual nos pone en contradicciones con quienes buscan una solución al conflicto por la vía militar. Entonces porque nos persiguen, discriminan y amenazan a nosotros los campesinos pobres?</p>
<p>&lt;!&#8211;6)   Los campesinos anti-indios solicitamos a organismos defensores de derechos humanos Nacionales e Internacionales mantener vigilantes ante las sesgadas y mal intencionadas acusaciones del CRIC y paHECES que  desde años atrás vienen perturbando nuestra tranquilidad.</p>
<p>Los  municipios y sus pobladores campesinos del Cauca, Valle, Tolima y Huila han sido afectados por la violencia generada por el conflicto Indígena. Estos hechos violentos que afecta la población civil campesina  generando la muerte a inocentes, desestabilizando la tranquilidad y la convivencia pacífica de los pobladores campesinos y negros. Frente a estos hechos de lesa humanidad contra los campesinos; hacemos un llamado a la solidaridad nacional e internacional, a los organismos de derechos humanos y DIH para que medien, frente a los actores en conflicto y la población civil no siga siendo afectada por los indios.</p>
<p>Campesinos del Cauca (Colombia), denunciamos la privatización por Indígenas de los recursos naturales, «única fuente de supervivencia de los campesinos Pobres»</p>
<p>Colombia no es solo la guerrilla de las FARC, ni el gobierno del presidente Uribe, aunque fuera del país sean las noticias relacionadas con ambos las que más espacio ocupan en los medios de comunicación. Para hablar de la otra realidad y de los otros colombianos, en este caso de los campesinos  del Cauca, Valle, Huila y Tolima</p>
<p>.El CRIC y paHECES  salen a decir por fuera del país que  andan defiendo la autodeterminación de su territorio desde la resistencia pacífica que apuestan por un pacto de los indígenas, campesinos, afrocolombianos y sindicalistas para trabajar una agenda popular que lleve a la consecución de sus objetivos y a resolver los graves problemas de las comunidades indígenas del país que están siendo desposeídas de sus tierras y con ello de su medio de vida. Eso es mentira porque a nosotros nos arrebatan y obligan a vender las tierras.</p>
<p>De ahí que, siendo también, tan graves los problemas estructurales de los campesinos y negros  colombianos,  reivindicamos, por una parte, el derecho a dar a conocer esa otra realidad de nuestro  país y, por otra, la ayuda y la solidaridad del exterior. La presencia de las FARC con ser grave, no es el problema de fondo de Colombia, lo es el hambre y la privatización de los recursos naturales por parte de los Indígenas sea cual fuere, que nos niegan el agua y la tierra, todo esto orientado por exguerrileros y fensuagro.</p>
<p>Nosotros no estamos de acuerdo con la política de la guerrilla ni con los secuestros, no compartimos que se prive a la gente de su libertad, ni que nos perturben nuestra tranquilidad  de nuestros hijos campesinos, también necesitamos comer, beber agua,  pero tampoco queremos que se use eso para tapar el resto de la problemática que hay en Colombia con los campesinos.</p>
<p>En cuanto al tema que manifestamos, aseguramos que las comunidades indígenas están sometiendo a un «plan integral de agresión» y que la privatización de los recursos, tierra, aguas, se ha llevado a cabo para favorecer la entrada al medio rural solo sus intereses etnocentricos  y xenofóbicos,  para apoderarse y explotar los recursos naturales del Huila, Valle y Cauca,  donde precisamente estamos los Campesinos, afros y urbanos pobres que tenemos casas de descansos, que subsistimos de nuestra economía campesina. Por otra parte, acusamos al CRIC y paHECES de estar sembrando el terror y zozobra en nuestras pequeñas  propiedades.</p>
<p>Los desplazamientos no solo lo hace la guerrilla, también los propician los indígenas  y especialmente el CRIC y paHECES que nos obligan a instalarse en las principales ciudades sin trabajo, y que cuando regresamos a las fincas, se encuentran con sus tierras saqueadas, quemadas y dicen que. «ya no somos dueños de la tierras. No entendemos sus políticas.</p>
<p>El CRIC y paHECES y sus Cabildos exigen el autogobierno y proclaman la defensa de la vida y del territorio pero a nosotros no nos respetan, por tanto tendremos que actuar de otra forma para poder vivir.</p>
<p>Pero “sabemos quién más” co-actuan, odian y amedrantan al mismo tiempo que si se hace justicia y se descubre de verdad que en el más alto nivel CRIC están los asesores criminales, entonces se falta al respeto. Nos sentencian a la represión en nombre del respeto, convivencia pacífica, resistencia, igual que el gobierno coinciden en sus intereses.</p>
<p>Hablamos desde  Popayán al pueblo Caucano – Colombiano y al Mundo. Que quede constancia, !NO A LA DICTADURA! ¡NO MAS IMPUNIDAD NI INJUSTICIA PARA BENEFICIO DE CRIMINALES Y LADRONES del CRIC y paHECES</p>
<p>Nosotros, los campesinos, somos gente tranquila, nos asombro cuando los del CRIC y paHECES mataron entre ellos en Silvia, entonces vemos que ni ellos se respetan, no aguantamos mas, y somos enfáticos, la única y verdadera solución es que reformen su sus actos o actuaremos bajo nuestros criterios de Seguridad que lo estamos gestando con financiación propia Es lo único que puede desterrar el terrorismo, que son las peores amenazas de nuestra tranquilidad, en tiempos pasados sin CRIC todo era tranquilo y no habían disgustos..</p>
<p>El senador Piñacue en sus discursos solo habla para ellos, donde dice que los paHECES son el motor que creen en las leyes, hablan de paciencia y fuerza heroica cuando a los pequeños campesinos los tienen aterrorizados, hablando de adversidades y amenazas, la tragedia que dice esta persona la creo el CRIC desde 1991, y ellos mismos dicen estar cansados, se cansan de no hacer nada, sudan de no hacer nada, dicen luchar por el territorio, será todo el cauca, toda Colombia, toda América? Tonto e iluso discurso por que la pretensión de Piñacue, es eliminar a los campesinos, Negros y hasta matarse entre Indios. Aunque en el congreso digan todo lo contrario-</p>
<p>No tenemos más alternativa que manifestarnos por este medio y defender nuestras vidas y convocar a la humanidad para que no permita que se extinga nuestra tranquilidad en nuestras tierras. También somos patrimonio de vida y responsabilidad de todos los campesinos y negros. Los criminales y mezquinos del CRIC crean zozobra que la deben pagar hasta con  la muerte porque, ordenan las acciones de desalojo, mienten y matan para “acumular”, merecen ser castigados por la justicia</p>

<p>Atentado al medio ambiente en Extremadura apoyado por el PSOE</p>

<p>On Friday 4th July 2008 the Plataforma Ciudadana Refinería No [PCRN, Citizens’ anti-refinery campaign] was represented by a notary at the Department of Industry, Energy and Environment of the Provincial Government of Extremadura in order to hand over the campaign’s objections to the oil refinery in Extremadura, promoted by the Group of “associates” of A. Gallardo and supported by Rodríguez Zapatero’s PSOE [Partido Socialista Obrero Español, the Spanish Socialist party].  These objections, addressed to the Ministries of Industry and of the Environment and to the Regional Government itself, consisted of some nine boxfuls of documents as well as documents on CD and seven bound volumes.  And accompanying those documents, a first submission of 55,000 signatures against the project which the PCRN has collected in the district.  A curious fact which can give an idea of the volume of the objections is that it took nine people to carry them through the premises of the Provincial Government.</p>
<p>Sources in the Provincial Government state that there is no precedent in the history of Extremadura of any project against which such voluminous and well-developed objections have been presented. <span id="more-196"></span> This circumstance is especially relevant if we take into account the tremendous difficulties which have been and are still being encountered by PCRN and the general public over the time of consultation for the Environmental Impact Study and the short time allowed for for consultation and for receipt of objections (the minimum stipulated by law for so large a project).  By any reckoning the administration (as a “partner” in the investment with a minimum of 20% through SOFIEX [Sociedad de fomento industrial de Extremadura, Society for Promotion of Industry in Extremadura]) has not only ignored its obligation to guarantee the right of citizens to participate in the proceeding, but has taken pains to curtail that right.<br />
To those difficulties must be added those detected by this Campaign, by groups, associations and private individuals at the time for delivering objections to the public registries, which, according to law, are obliged to record receipt of any documentation addressed to public bodies which is presented to them, regardless of its bulk or of the trouble that could be caused to anyone by the decision of many thousands of citizens to exercise their right to object to the proposal for an oil refinery within the Iberian Peninsula.  It was due to these circumstances that recourse was had to the presence of a notary, who would make an official report on registration of the objections.</p>
<p>In this first delivery of 55,000 signatures, and some 20,000 objections (as of today), we have overwhelmingly demonstrated the “surprise” effect on the administration, without calling on the media of communication.  We shall continue to deliver objections, even outside the minimum period stipulated by the promoters of the refinery of Gallardo and Zapatero’s PSOE, in order to give evidence of the mountain of irregularities, the technical and economic data presented by this petro-chemical “business”, and afterwards to demand legal and judicial responsibility of those who with their signatures approve (?) this refinery of extra-heavy crude oil within the Iberian Peninsula.</p>
<p>In the middle of the week PCRN will give a press conference, mainly in order to publicize news of the accusations against the eleven citizens of PCRN made on behalf of Villafranca de los Barros PSOE, together with coverage and evaluation of the collection and processing of objections.  As a taster, on Tuesday 8th July, the programme “Un Mundo Feliz” [“A Happy World”] on Radio 3, Spanish National Radio, will interview PCRN.</p>
<p>“Un Mundo Feliz”, presented by Fernando Puerto and Marta Gómez, is broadcast on Monday to Friday evenings from six o’clock to seven.<br />
We hope they will not suffer “professional reprisals” like other JOURNALISTS who have taken on this oil refinery on air and in PUBLIC and private media of communication.</p>
<p><strong>Versión en españo</strong></p>
<p>El viernes 4 de Julio-08,  la Plataforma Ciudadana Refinería No,  se personó con un notario en la Consejería de Industria, Energía y Medio Ambiente de la Junta de Extremadura para hacer entrega de sus alegaciones a la refinería de petróleos en Extremadura, promovida por el Grupo de &#8220;socios&#8221; de A. Gallardo y  apoyada por el PSOE de Rodríguez Zapatero. Dichas alegaciones (alrededor de 20.000 ), que iban dirigidas a los Ministerios de Industria y al de Medio Ambiente y a la propia Consejería, constaban de unas nueve cajas de documentación, además de documentos en CD y siete tomos encuadernados. Y acompañando a dicha documentación, una primera entrega de 55.000 firmas  que la Plataforma Ciudadana Refinería NO ha recogido en la comarca contra el proyecto. Un dato curioso y que puede dar una idea del volumen de las alegaciones es que para transportarlas por las dependencias de la Consejería fueron necesarias nueve personas.</p>
<p>Fuentes de la Consejería aseguraban que no existe precedente en la historia de Extremadura de otro proyecto al que se hayan presentado unas alegaciones tan voluminosas y desarrolladas. Esta circunstancia es especialmente relevante si tenemos en cuenta las tremendas dificultades que se ha encontrado y sigue encontrando la PCRN  y la ciudadanía en general a la hora de consultar el Estudio de Impacto Ambiental y el poco plazo establecido para su consulta y para la recepción de alegaciones (el mínimo establecido por la ley para un proyecto de tal magnitud).<br />
A todas luces la administración (como &#8220;socio&#8221; en la inversión con un mínimo del 20 % a través de SOFIEX) no sólo ha ignorado su obligación para garantizar el derecho de los ciudadanos a participar en el procedimiento, sino que se ha esforzado en que dicho derecho se vea cercenado.</p>
<p>A dichas dificultades se han de añadir las que desde esta Plataforma, colectivos, asociaciones  y desde numerosos ciudadanos a nivel particular se han detectado a la hora de hacer entrega de las alegaciones en los registros públicos que, según la ley, tienen la obligación de dar registro de entrada a cualquier documentación dirigida a instancias públicas que se les presente, independientemente de su volumen o de lo engorroso que pueda resultar a alguien el hecho de que miles y miles de ciudadanos se hayan decidido a ejercer su derecho a alegar contra el proyecto de refinería de petróleos en el interior de la Península Ibérica.  Debido a esas circunstancias es el hecho de recurrir a la presencia de un notario que levantase acta  del registro de las alegaciones.</p>
<p>En esta 1º entrega de 55.000 firmas y alrededor de 20.000  alegaciones,( a fecha de hoy ), hemos probado el efecto &#8220;sorpresa&#8221; en la administración, desbordados,  sin convocar a los medios de comunicación. Seguiremos entregando alegaciones, aún fuera del plazo mínimo establecido por los promotores de la refinería de Gallardo y PSOE de Zapatero, para dar constancia del cúmulo de irregularidades, datos técnicos y económicos   que presenta este &#8220;negocio&#8221; petroquímico, y posteriormente, pedir responsabilidades legales y jurídicas a quien con su firma ¿apruebe?  esta refinería de crudos extra pesados en el interior de la Península Ibérica.</p>
<p>A mediados de semana la PCRN dará una rueda de prensa, principalmente para hacer público las novedades sobre las  imputaciones hacia los 11 ciudadanos de la PCRN  por parte del PSOE de Villafranca de los Barros, así como el seguimiento y valoración de la recogida y proceso de alegaciones. Como adelanto, el martes 8 de julio, el programa &#8220;Un Mundo Feliz&#8221; de Radio 3, Radio Nacional de España, entrevistará  a la PCRN.</p>
<p>&#8220;Un Mundo Feliz&#8221;, dirigido por Fernando Puerto y Marta Gómez se emite de lunes a viernes  de 18:00 a 19:00 h.</p>
<p>Esperemos que no sufran &#8220;represalias profesionales&#8221; como otros PERIODISTAS que han sacado esta refinería de petróleos en antenas y medios de comunicación PÚBLICOS y privados.</p>

On 28th and 29th May of this year, James Anaya, the new United Nations Rapporteur on the rights and freedoms of indigenous peoples, visited the Constituent Assembly of Ecuador.  In his recently-released report on this visit, the Rapporteur pleads for inclusion in the new constitutional text of plurinationality and prior informed consent.<br />
With regard to recognition of the plurinationality of the Ecuadorian State, a historic proposal of the national indigenous organization CONAIE, Anaya emphasizes that in essence it corresponds with the normative framework developed at international level.  For him, “acceptance of plurinationality in the framework of the constitution would reinforce Ecuadorian Society’s commitment to recognize indigenous nations and peoples and to the ‘pluricultural’ State already reflected in the 1998 Constitution”.  He also rejects concerns that plurinationality would involve dangerous tendencies towards fragmentation of the country, for which reason he has told the members of the Constituent Assembly that these concerns “are without foundation and can and must be overcome”.<br />
On the right to free, prior, informed consent, the Special Rapporteur considers that inclusion of the debate<span id="more-193"></span> on whether or not indigenous peoples should enjoy a constitutional right of veto in order to curb plans for development or extraction of hydrocarbons or minerals, which by law belong to the State, is inconsistent with these principles inasmuch as they are established in international law.  On the contrary, he states that “the principles of consultation and consent are intended to further mutual understanding and consensus in the taking of decisions”.<br />
He recalls that these principles respond to “a history in which indigenous peoples have repeatedly been denied participation in the taking of decisions which have affected them profoundly, often to the detriment of their fundamental human rights and on occasions even of their very survival as peoples”.  Therefore, in situations where the measure proposed for adoption would have substantial impacts which could endanger the physical or basic cultural wellbeing of the indigenous community concerned, “the State certainly has the duty of not adopting the measure without the community’s consent,” as Anaya said, quoting the pronouncement of the Inter-American Court of Human Rights in the case of Saramaka v. Suriname, resolved in November 2007.<br />
To support his views, the Special Rapporteur refers to Agreement 169 of the International Labour Organization, and especially to the United Nations Declaration on the Rights of Indigenous Peoples, which reinforces the model of the plural State including indigenous peoples, communities and nations.  This international instrument explicitly recognizes the right to free, prior, informed consent.<br />
In the Assembly of the United Nations Organization in which the Declaration was approved (September 2007) the Ecuadorian Government representative cast his vote in favour and said, in the name of Ecuador:<br />
“Today we express our commitment to apply and implement the declaration in every policy of the State&#8230;”<br />
This commitment, made in the name of the Government headed by Rafael Correa in the highest forum of Humanity, binds him to the international community and to his own people.  A legitimate Government may not go back on its word to guarantee rights in response to the vicissitudes of internal politics.  The Constitutional President of the Republic is therefore ethically, judicially and politically obliged to review his opposition to full incorporation in the text of the new Constitution of the rights of indigenous nations and peoples.<br />
The Special Rapporteur’s important visit has usefully cast light on the international promises which Ecuador has made to the international community in the matter of Indigenous Rights.<br />

<p>El Relator de Naciones Unidas sobre los Pueblos Indígenas aboga por derechos colectivos en la nueva Constitución del Ecuador<br />

Los días 28 y 29 de mayo de este año, James Anaya, nuevo Relator de Naciones Unidas sobre los derechos y libertades de los pueblos indígenas, visitó la Asamblea Constituyente del Ecuador. En su reporte sobre esta visita, recientemente difundido, el Relator aboga a favor de la inclusión de la plurinacionalidad y del consentimiento informado previo en el nuevo texto constitucional.<br />
Respecto al reconocimiento de la plurinacionalidad del Estado ecuatoriano,  propuesta histórica de la organización nacional indígena CONAIE, Anaya destaca que en su esencia se corresponde con el marco normativo que se ha desarrollado a nivel internacional. Para él “la aceptación de la plurinacionalidad en el marco constitucional reforzaría el compromiso de la sociedad ecuatoriana con respecto al reconocimiento de las nacionalidades y pueblos indígenas y de un estado “pluricultural” ya reflejado en la Constitución de 1998.”  Desestima, además, las preocupaciones surgidas en torno a que la plurinacionalidad implique tendencias peligrosas hacia la fragmentación del país, por lo que ha señalado a los asambleístas constitucionales que estas preocupaciones “carecen de fundamento y que pueden y deben ser superadas”.<br />
Sobre el derecho al consentimiento libre, previo e informado, el Relator Especial considera que enmarcar el debate en que si los pueblos indígenas deberán o no gozar de un derecho constitucional de veto para frenar planes de desarrollo o extracción de hidrocarburos o minerales que por ley pertenecen al Estado, no encaja en el espíritu de estos principios tal como están sentados en la normativa internacional. Por lo contrario, señala que “los principios de consulta y consentimiento buscan promover el entendimiento mutuo y en consenso en la toma de decisiones”. Recuerda que estos principios  responden “a una historia en que se ha negado repetidamente a los pueblos indígenas la participación en la toma de decisiones que les han afectado profundamente, muchas veces en detrimento de sus derechos humanos fundamentales y en ocasiones hasta de su propia supervivencia como pueblos”. Por eso, en situaciones en las que la medida que se pretende adoptar tendría impactos substanciales que podrían poner en peligro el bienestar físico o cultural básico de comunidad indígena interesada, “el Estado sí tiene el deber de no adoptar la medida sin el consentimiento de comunidad”, señala Anaya citando el pronunciamiento de la Corte Interamericana de derechos Humanos en el caso Saramaka v. Suriname, resuelto en noviembre de 2007.<br />
Para fundamentar sus posiciones, el Relator Especial se remite al Convenio 169 de la OIT y en especial, a la Declaración de las Naciones Unidas sobre los Derechos de los Pueblos Indígenas, que refuerza el modelo del estado plural incluyente de los pueblos, comunidades y nacionalidades indígenas. Este instrumento internacional reconoce explíctamente el derecho al consentimiento libre, previo e informado.<br />
En la Asamblea de la ONU en la que se aprobó la Declaración (septiembre de 2007), el representante del Gobierno ecuatoriano expresó su voto favorable y a nombre del Ecuador dijo:<br />
“Hoy expresa su compromiso  de aplicar e implementar la declaración en todas las políticas estatales…”.<br />
Este compromiso, asumido a nombre del Gobierno presidido por Rafael Correa en el más alto foro de la Humanidad, lo vincula con la comunidad internacional y con su propio pueblo. Un Gobierno legítimo no debe traicionar su palabra de garantizar los derechos, frente a los avatares de la política interna. Por eso, el presidente Constitucional de la República está en la obligación ética, jurídica y política de revisar su oposición a que la Asamblea Constituyente incorpore plenamente los derechos de las nacionalidades y pueblos indígenas en el nuevo texto constitucional.<br />
La importante visita del Relator Especial ha sido útil para visibilizar los compromisos internacionales que el Ecuador tiene con la comunidad internacional en materia de Derechos Indígenas.<br />

<p><strong>Scots investors accused of backing £400m mine that threatens remote Indian<br />
tribe</strong></p>

<p>Pressure building on companies to sell their shares in mine’s owner By Billy<br />

<p>THE FUTURE of a remote tribe in India could be under threat from a proposed<br />
mining development indirectly funded by Scottish companies and the nation&#8217;s<br />
universities. Mining giant Vedanta Resources plans to create an open-cast<br />
bauxite mine in the mountainous east Indian state of Orissa, an area that is<br />
home to the Dongria Kondh tribe.</p>
<p>Protesting tribesmen and Survival International &#8211; an organisation that<br />
fights on behalf of those whose cultures and human rights are threatened by<br />
the modern world &#8211; have launched a campaign against the FTSE 100 company and<br />
shareholders.</p>
<p>Campaigners, including Oscar-winning actress Julie Christie, claim the mine<br />
would end the tribe&#8217;s way of life by polluting streams, cutting down forests<br />
and destroying a mountain that people hold sacred.</p>
<p>Vedanta vigorously disputes the allegations and says it has a strong focus<br />
on meeting its environmental responsibilities and a proud record of helping<br />
communities in countries where it operates.</p>
<p>Survival is targeting not only Vedanta, but its major shareholders,<br />
including Coutts Bank, Standard Life, Barclays Bank, Abbey National and<br />
HSBC, urging them to sell their stakes unless the firm abandons its plans.<br />
The Norwegian government recently sold its stake in Vedanta as a result of<br />
the campaign.</p>
<p>Scotland&#8217;s universities &#8211; including Glasgow, Edinburgh, Aberdeen and St<br />
Andrews &#8211; have money invested in Vedanta through the Universities<br />
Superannuation Scheme (USS), which holds more than one million shares in the<br />
company. The Dundee-based Alliance Trust and Martin Currie Investment<br />
Management of Edinburgh also have funds invested in the company.<br />
<span id="more-188"></span></p>
<p>Vedanta&#8217;s subsidiary, Sterlite, plans to mine aluminium ore from an area<br />
where about 10,000 people live. The proposed £400 million project has<br />
already brought about clashes between local tribal people and security<br />
forces. Hundreds of members of the Dongria Kondh tribe held a protest in<br />
India recently, marching through Bhubaneswar, the capital of Orissa state,<br />
and staging a sit-down protest near the state assembly.</p>
<p>Jitu Jakasika, a Dongria Kondh protestor, said that if the mining project is<br />
allowed to proceed, it will destroy the hill&#8217;s ecosystem and dry up two<br />
major rivers and 36 streams. &#8220;It will destroy the livelihoods of 10,000<br />
tribals and the religious sanctity of our beloved Niyamgiri,&#8221; he added.</p>
<p>Survival&#8217;s director, Stephen Corry, said other investors should follow the<br />
Norwegian government&#8217;s example and offload their Vedanta shares or face<br />
boycotts over their human rights record. &#8220;The tribe cannot survive as a<br />
people without their land,&#8221; he added.</p>
<p>The proposal has been several years in the approval process and has been<br />
backed by both the national and state governments in India. A final ruling<br />
from the Indian Supreme Court is imminent.</p>
<p>Vedanta vigorously disputes the claims made by Survival and said it takes<br />
human rights very seriously. &#8220;It is fundamental to the way we work to ensure<br />
that all our operations provide benefit in all the communities in which we<br />
operate,&#8221; a spokesman said. &#8220;At the Niyamgiri Hills there is no habitation<br />
on the bauxite mining area, as confirmed by the team of experts from Wild<br />
Life Institute of India.</p>
<p>&#8220;We fully support this plan. We ensure the best practices in environmental<br />
management and through the years have taken proactive steps towards being<br />
compliant with evolving standards.&#8221;</p>
<p>Scotland&#8217;s universities, and their superannuated employees, indirectly fund<br />
Vedanta through the Universities Superannuation Scheme (USS), which invests<br />
to provide pensions for staff.</p>
<p>David Russell, head of responsible investment at USS, said the fund is aware<br />
of Vedanta&#8217;s activities in India and would be meeting with the firm to<br />
discuss the issue, along with the Norwegian Government&#8217;s divestment<br />
decision.</p>
<p>&#8220;USS&#8217;s trustees believe that the fund can and should take ethical,<br />
environmental governance issues into account in its investment<br />
decision-making. It is worth noting that we only invest in the company via<br />
our index fund &#8211; a passive fund in which we invest in the whole UK FTSE<br />
index of 700+ companies,&#8221; he said.</p>
<p>The USS fund has more than 390 member institutions and more than 240,000<br />
individuals for which it invests and pays pensions. It is governed under UK<br />
trust law and in this regard is unlike a governmental fund that enables<br />
individuals to express their personal values in their investments.</p>
<p>Mr Russell said USS responsible investment (RI) policy must be consistent<br />
with its legal responsibility under trust law. &#8220;This means treating the<br />
financial interests of our members as paramount and managing the fund<br />
consistent with proper diversification and prudence. This means that the<br />
fund invests in more than 1500 companies from around the world. The legal<br />
advice received by the fund is that USS is not permitted to make investment<br />
decisions based purely on ethical or moral factors, and we hence can only<br />
divest on the basis of material financial grounds. However, USS&#8217;s trustees<br />
believe that the fund can and should take ethical and environmental issues<br />
into account in its investment-decision making where they are material to a<br />
company&#8217;s performance.</p>
<p>&#8220;USS, therefore, seeks to integrate these factors into investment analysis<br />
and engages with companies on these issues,&#8221; he said.</p>
<p>A spokesman for the University of Edinburgh said USS sets its own investment<br />
principles, but that the institution&#8217;s investment committee strictly adheres<br />
to a socially responsible investment policy. &#8220;The university has in place<br />
procedures to consider any matters that are raised and the University<br />
Court&#8217;s approach is one of engagement with companies on ethical issues<br />
through the fund managers&#8217; corporate governance unit,&#8221; a spokesman said.</p>
<p>The University of Glasgow said it also requires investment managers to have<br />
socially responsible investment (SRI) policies, so that when concerns are<br />
raised the behaviour of companies can be influenced by shareholders.</p>
<p>&#8220;While the university would not comment on the specific actions, or proposed<br />
actions, of an individual company, we would emphasise our commitment to SRI<br />
as a means of encouraging companies to demonstrate socially responsible<br />
corporate policies,&#8221; a spokesman said.</p>
<p>The Alliance Trust, based in Dundee, confirmed it had £20m invested in<br />
Vedanta. A spokesman said: &#8220;Our company policy is to give investment<br />
managers the flexibility to invest where they believe that they can make the<br />
best return for our shareholders. As part of any investment decision, we<br />
take all the relevant factors into consideration, including corporate social<br />
responsibility and environmental issues.&#8221;</p>
<p>Martin Currie Investment Management in Edinburgh said it expects companies<br />
in which it invests to behave both within the law and morally. &#8220;Our approach<br />
is to invest based on evidence, so we sent a detailed list of questions to<br />
Vedanta and asked to speak with Survival to discuss its claims.</p>
<p>&#8220;We have now received responses to our structured questions from Vedanta. We<br />
are still trying to arrange a call with Survival. Once we are able to assess<br />
the evidence properly and fully, we will decide what to do with the shares,&#8221;<br />
a spokesman said.</p>
<p>Standard Life in Edinburgh declined to comment.</p>

<p>The current massive wave of investment in energy production based on<br />
cultivating and industrial processing of vegetal materials like corn,<br />
soy, palm oil, sugar cane, canola, etc, will neither solve the<br />
climate crisis nor the energy crisis. It will also bring disastrous<br />
social and environmental consequences. It creates a new and very<br />
serious threat to food production by small farmers and to the<br />
attainment of food sovereignty for the world population.</p>
<p>Over the last twenty years the neoliberal policies adopted globally<br />
have failed to answer people&#8217;s basic needs. The FAO promises at the<br />
1996 World Food Summit and the UN Millenium Development Goals to lift<br />
people out of poverty have not been kept. Many more people are<br />
suffering form hunger.</p>
<p>It is claimed that agrofuels will help fight climate change. In<br />
reality, the opposite is true. The new extensive monoculture<br />
plantations for the production of agrofuels are increasing greenhouse<br />
gases through deforestation, drainage of wetlands, and dismantling<br />
communal lands. If we take into account the whole cycle of<br />
production, transformation, distribution of agrofuels, they do not<br />
produce less greenhouse gases than fossil fuels, except in some<br />
cases. Moreover, agrofuels will never be able to replace fossil<br />
fuels. According to the latest estimates, they will only cover the<br />
future rise in consumption from now until 2020. There is simply not<br />
enough land in the world to generate all the fuel necessary for an<br />
industrial society whose needs for transport of people and goods are<br />
continually increasing. The promise of agrofuels creates the illusion<br />
that we can continue to consume energy at an ever growing rate. The<br />
only answer to the threat of climate change is to reduce energy use<br />
worldwide, and to redirect international trade towards local markets.</p>
<p>Meanwhile, the social and ecological impacts of agrofuel development<br />
will be devastating. Monoculture and industrial agriculture, whether<br />
for agrofuel or any other production, are destroying land, forests,<br />
water and biodiversity. They drive family farmers, men and women, off<br />
their land. It is estimated that five million farmers have been<br />
expelled from their land to create space for monocultures in<br />
Indonesia; five million in Brazil, four million in Colombia&#8230;<br />
Industrial agriculture generates much less employment than<br />
sustainable family farming; this is an agriculture without farmers.</p>
<p>The current expansion of agrofuel production contributes to the<br />
massive concentration of capital by landowners, large companies and<br />
TNCs, provoking a real counter land reform throughout the world.<br />
Moreover it contributes to increased speculation on food products and<br />
land prices.</p>
<p>Agrofuel production has already started to replace food production.<br />
Its ongoing extension will drive even more small scale farmers and<br />
indigenous peoples off their lands. Instead of dedicating land and<br />
water to food production, these resources are being diverted to<br />
produce energy in the form of diesel and ethanol. Today peasants and<br />
small farmers, indigenous people, women and men, produce the huge<br />
majority of the food consumed worldwide. If not prevented now,<br />
agrofuels will occupy our lands and food will become even more scarce<br />
and expensive.</p>
<p>Who would eat agrofuels?</p>
<p>A new alliance of some governments with automotive and chemical<br />
companies, oil and agro-industry is promoting agrofuels with the sole<br />
objective of making money. The fear of climate change and energy<br />
crisis is used to develop agrofuel production in a manner that<br />
maintains and strengthens an agro-industrial model. Knowing that<br />
this model is, in itself, a major cause of climate change and an<br />
intensive energy consumer, is no obstacle.</p>
<p>Technology and market control of the TNCs strengthen and increase<br />
their hold over the agrarian sector. The family farmers whose food<br />
production has been based on traditional seeds, are displaced, their<br />
coexistence with biodiversity, their way of producing energy by human<br />
and animal force are disrupted. Their way of life uses much less<br />
energy per unit of food produced, and specially, fewer fossil fuels.</p>
<p>Agribusiness companies are aware that agrofuels produced on a large<br />
scale are not economically viable. The race towards agrofuels is<br />
made possible by the huge direct and indirect subsidies from<br />
supporting governments and by speculation on the financial markets,<br />
which is also causing food prices to rise.</p>
<p>The figures cited are alarming. Millions of hectares and billions of<br />
dollars are mentioned: the government of India is contemplating<br />
planting 14 million hectares with &#8220;jatrofa&#8221;, the Inter-American Bank<br />
of Development says that Brazil has 120 million hectares ready for<br />
agrofuel production and a business lobby suggests that there are 397<br />
million hectares available in 15 African countries. This means a<br />
level of expropriations without precedent.</p>
<p>While TNCs and investment funds increase their profits, a large part<br />
of the world population does not have enough money to buy food.<br />
Agrofuels are estimated to be responsible for 30% of the current food<br />
price crisis.</p>
<p>When the TNCs are unable to find farmland for agrofuel production,<br />
deforestation is forced on areas that are necessary for the<br />
preservation of life on earth.</p>
<p>Thousands of farmers have no alternative but to accept to grow<br />
agrofuels as they need an income to support themselves till the next<br />
season. National and international agricultural policies imposed by<br />
international financial institutions and TNCs have exacerbated the<br />
dependence of developing countries, leading to food crisis, extreme<br />
poverty, and hunger throughout the world. Therefore, those small<br />
farmers are not guilty of making the wrong choice they are the<br />
victims of the current system imposed on them.</p>
<p>Small farmers and agricultural workers, working in extremely harsh<br />
conditions with damaging effects on their health, with very poor<br />
income have no say in the way their production is used. Many are<br />
working under contract farming with large agribusiness companies that<br />
process, refine and sell the product. Therefore it is the companies<br />
who decide to channel the produce to the fuel rather than to the food<br />
market. The high food prices paid by the consumers are not reflected<br />
in the small farmers&#8217; income.</p>
<p>In response to energy crisis: small scale production and local<br />
consumption</p>
<p>Small scale sustainable farming is essential to feed the world.<br />
Sustainable family farming and food sovereignty consume up to 80 times<br />
less energy than industrial agriculture.</p>
<p>Food sovereignty primarily involves the use of local resources for<br />
food production, minimizing imports of raw materials as well as<br />
transport. Likewise, the food produced is consumed locally so that<br />
the end product does not travel far. It is not logical to eat, in<br />
Europe, aspargus coming all the way from the Altiplano or fresh green<br />
beans coming from Kenya.</p>
<p>Throughout the history of farming, villagers have obtained energy<br />
from their farmland to meet their daily needs. Peasant families are<br />
using coconut or sunflower oil, biogas, firewood, wind and water to<br />
generate electricity for local use. Such methods are sustainable and<br />
integrated into the food production cycle on the farmland.</p>
<p>It is imperative to design and adopt responsible attitudes to food<br />
consumption and to adjust our way of eating, in the knowledge that the<br />
industrial model of production and consumption is destructive, while<br />
the peasant-based model of production uses responsible energy<br />
practices.</p>
<p>Therefore, Via Campesina continues its struggle against the power of<br />
large corporations and supporting political systems. The energy<br />
crisis should not be seen as an isolated problem but as part of the<br />
whole crisis of the current model of development where profit has<br />
priority over people.</p>
<p>Instead, we support a people centered, small-scale diversified<br />
agriculture with local markets and healthy livelihoods using less<br />
energy and less dependent on external sources. Sustainable family<br />
farmers fulfill the fundamental mission of agriculture: to feed<br />
people.</p>
<p>Via Campesina denounces:</p>
<p>+ The neoliberal model, international financial institutions and<br />
transnational capital, directly responsible for the food and the<br />
climate crisis.</p>
<p>+ The irresponsible presentation of agrofuels as an answer to the<br />
climate and energy crisis</p>
<p>+ The scandal of producing agrofuels in a world ravaged by hunger.</p>
<p>+ The passive attitude of many institutions faced with the serious<br />
risk posed by the advent of agrofuels which implies that rural and<br />
urban populations can neither produce nor consume food.</p>
<p>+ That these same institutions are in fact placing the economic<br />
interests of TNCs above the food and nutritional needs of the very<br />
people they are entrusted to represent and defend.</p>
<p>+ The insult of continuing to promote agrofuels in spite of the<br />
negative energy balance in their production, processing, and<br />
transport.</p>
<p>+ The neoliberal model, international financial institutions and<br />
transnational capital, directly responsible for the food and the<br />
climate crisis.</p>
<p>Via Campesina demands:</p>
<p>The end of corporate driven, monoculture- based production of<br />
agrofuels. As a first step, a five year international moratorium on<br />
the production, trade and consumption of industrial agrofuels has to<br />
be immediately declared.</p>
<p>An in-depth evaluation of social and environment cost of the agrofuel<br />
boom and of profits made by TNCs in the processing and trade of the<br />
raw materials.</p>
<p>The promotion and development of small scale production and local<br />
consumption models and the rejection of consumerism</p>
<p>Explicit support from governments and institutions to the sustainable<br />
peasant-based model of food production and distribution, with its<br />
minimal use of energy, its capacity to create jobs, to respect<br />
cultural and biological diversity and its positive effect on global<br />
warming (fertile soils are the best way to capture CO2).</p>
<p>The reorientation of agricultural policies towards sustainable rural<br />
communities and livelihoods based on food sovereignty and genuine<br />
agrarian reform.</p>
<p>The promotion and development of responsible consumption models.</p>
<p>Let&#8217;s put out the fire of agrofuels and carry the flame of food<br />
sovereignty!</p>

Although indigenous organizations, scholars, and other national and institutional bodies already knew about these groups, the story was sold as if a new discovery was made in order to generate world wide awareness and halt logging operations in the area.</p>
<p>Nevertheless we should be cautious with this approach as it seems the only requisite for the States and industries to stop extractive operations in these areas is the existence of non-contacted tribes. What about other areas where we find contacted indigenous people who have chosen a life style not based on the rampant consumerism of the neoliberal world system?, what about areas which are considered sacred by the indigenous peoples who have been living there for centuries?</p>
<p>We must be careful with using photographs and other &#8220;proves&#8221; as the only way to stop unsustainable developments in the Amazon. Do indigenous groups must prove their indigenousness to the dominant societies? what does it mean to be &#8216;indigenous&#8217; for the dominant society?. We should put more energy on proving why we should not expand the extractive frontiers to sensitive areas. We should prove there are other ways of development which do not require to gamble with the existence of non contacted indigenous groups and do not require to put a price to lives and nature.</p>

Secret of the &#8216;lost&#8217; tribe that wasn&#8217;t</p>
<p>Tribal guardian admits the Amazon Indians&#8217; existence was already known, but<br />
he hoped the publicity would lift the threat of logging</p>

<p>They are the amazing pictures that were beamed around the globe: a handful<br />
of warriors from an &#8216;undiscovered tribe&#8217; in the rainforest on the<br />
Brazilian-Peruvian border brandishing bows and arrows at the aircraft that<br />
photographed them.</p>
<p>Or so the story was told and sold. But it has now emerged that, far from<br />
being unknown, the tribe&#8217;s existence has been noted since 1910 and the<br />
mission to photograph them was undertaken in order to prove that<br />
&#8216;uncontacted&#8217; tribes still existed in an area endangered by the menace of<br />
the logging industry.</p>
<p>The disclosures have been made by the man behind the pictures, José Carlos<br />
Meirelles, 61, one of the handful of sertanistas – experts on indigenous<br />
tribes – working for the Brazilian Indian Protection Agency, Funai, which is<br />
dedicated to searching out remote tribes and protecting them.</p>
<p><span id="more-175"></span>In his first interviews since the disclosure of the tribe&#8217;s existence,<br />
Meirelles described how he found the group, detailed how they lived and how<br />
he planned the publicity to protect them and other tribes in similar danger<br />
of losing the habitat in which they have flourished for hundreds of years.</p>
<p>Meirelles admitted that the tribe was first known about almost a century ago<br />
and that the apparently chance encounter that produced the now famous images<br />
was no accident. &#8216;When we think we might have found an isolated tribe,&#8217; he<br />
told al-Jazeera, &#8216;a sertanista like me walks in the forest for two or three<br />
years to gather evidence and we mark it in our [global positioning system].<br />
We then map the territory the Indians occupy and we draw that protected<br />
territory without making contact with them. And finally we set up a small<br />
outpost where we can monitor their protection.&#8217;</p>
<p>But in this case Meirelles appears, controversially, to have gone out to<br />
seek and find the uncontacted tribe in an area where it was known to be<br />
living.</p>
<p>According to his account, the Brazilian state of Acre offered him the use of<br />
an aircraft for three days. &#8216;I had years of GPS co-ordinates,&#8217; he said.<br />
Meirelles had another clue to the tribe&#8217;s precise location. &#8216;A friend of<br />
mine sent me some Google Earth co-ordinates and maps that showed a strange<br />
clearing in the middle of the forest and asked me what that was,&#8217; he said.<br />
&#8216;I saw the co-ordinates and realised that it was close to the area I had<br />
been exploring with my son – so I needed to fly over it.&#8217;</p>
<p>For two days, Meirelles says, he flew a 150km-radius route over the border<br />
region with Peru and saw huts that belonged to isolated tribes. But he did<br />
not see people. &#8216;When the women hear the plane above, they run into the<br />
forest, thinking it&#8217;s a big bird,&#8217; he said. &#8216;This is such a remote area,<br />
planes don&#8217;t fly over it.&#8217;</p>
<p>What he was looking for was not only proof of life, but firm evidence that<br />
the tribes in this area were flourishing – proof in his view that the policy<br />
of no contact and protection was working. On the last day, with only a<br />
couple hours of flight time remaining, Meirelles spotted a large community.</p>
<p>&#8216;When I saw them painted red, I was satisfied, I was happy,&#8217; he said.<br />
&#8216;Because painted red means they are ready for war, which to me says they are<br />
happy and healthy defending their territory.&#8217;</p>
<p>Survival International, the organisation that released the pictures along<br />
with Funai, conceded yesterday that Funai had known about this nomadic tribe<br />
for around two decades. It defended the disturbance of the tribe saying<br />
that, since the images had been released, it had forced neighbouring Peru to<br />
re-examine its logging policy in the border area where the tribe lives, as a<br />
result of the international media attention. Activist and former Funai<br />
president Sydney Possuelo agreed that – amid threats to their environment<br />
and doubt over the existence of such tribes – it was necessary to publish<br />
them.</p>
<p>But the revelation that the existence of the tribe was already established<br />
will provoke awkward questions over why a decision was made to try to<br />
photograph them – a form of contact in itself – in order to make a political<br />
point.</p>
<p>Meirelles, one of only five or so genuine sertanistas, has no regrets,<br />
arguing that the pictures and video released to the world were powerful and<br />
indisputable evidence to those who say isolated tribes no longer exist.<br />
&#8216;Alan García [the President of Peru] declared recently that the isolated<br />
Indians were a creation in the imagination of environmentalists and<br />
anthropologists – now we have the pictures.&#8217;</p>
<p>But he is determined to keep the tribe&#8217;s location secret – even under<br />
torture, he says. &#8216;They can decide when they want contact, not me or anyone<br />
else.&#8217;</p>

<p>It seems that the two unlike governments of Peru and Ecuador are both hunting for indigenous lands. Garcia’s Peru is determined to its mission of deregulation demanded by the Free Trade Agreement signed with USA. Therefore, the president has just issued a Decree that give the State access to indigenous lands, which are inalienable according to 1993 constitution (see article below).  Ecuador´s current leftish government, although has rule out any possibility of a free trade agreement with USA thanks to the indigenous, peasant, and social movilizations of 2006, is now moving a step backwards from ILO Convention 169 approved in 1998, by issuing the Decree 1040 which clearly curtails the right of participation of indigenous peoples in any administrative or legislative measure that may affect them (<strong>see article in resistance session <a href="http://redamazon.wordpress.com/resistance/#comment-163" target="_blank">here</a>)</strong><br />

<p>Legislative Decree 1015 which orders abolition of the peasant community in Peru is undemocratic, given that there has been no consultation with the community members;  antisocial, given that it encourages the creation of large estates, mainly foreign;  and unconstitutional, since it violates Articles 88 and 89 of the Charter.<br />
This decree, published yesterday in ‘El Peruano’, arrogantly begins by stating that its purpose is ‘implemention of the Peru-USA Agreement on the Promotion of Trade’.  That is, the Free Trade Agreement.<br />
A partial confession.  The item explains what interests (or orders) are those which inspire the series on ‘The gardener’s dog syndrome’ which President Alan García has published over a period of months in ‘El Comercio’.<br />
The first article, published on 28th October 2007, declared war on the communities.  Their land, it said, ‘sold in big parcels would bring technology which would also benefit the community member’ (who would no longer be a community member, but a labourer for an estate owner, Chilean at best, or of a large mining company).<br />
We foresaw it immediately.  And we condemn the ignorance of García, who affirmed in that text that the communities were the creation of Viceroy Toledo.  He is unaware that those institutions originated for the most part with the pre-Hispanic Ayllu.</p>

Just one question is enough to reveal the intention of the legislative decree.  Who are they that can buy those big parcels promised by García?<br />
It is most likely that behind the articles and the decree are certain large mining companies, whose poisoning of waters and life-threatening environmental contamination have been resisted by the communities.<br />
The project shamelessly violates Article 88 of the Constitution, which establishes that the State ‘guarantees the right of ownership of the land, privately, communally or in any other form of association’.<br />
The decree also violates Article 89 of the Constitution, which declares that peasant and native communities ‘are autonomous in their organization, in communal work and in the use and free disposition of their lands’.  Ownership of their lands, the constitutional measure continues, ‘is inalienable’.<br />
In subsection (b) of the legislative decree is the key to the crime:  acquisition of title to communal lands by third parties will require a vote in favour of no less than fifty per cent of those attending a meeting.<br />
In accordance with that, 25% of the community members assembled at a meeting, rigged at best, could decide the sale of all the community’s land.<br />
Why does García not establish the same rule for every kind of business and association?<br />
The declaration of war against the communities of the mountains and forest will no doubt unleash peasants’ anger and struggle.  It will be a case of legitimate defence.</p>

<p>El Gobierno de Peru y Ecuador a la caza de territorios indígenas.</p>
<p>Parece que los dos gobiernos dispares de Peru y Ecuador están a la caza de territorio indígena. El Peru de Garcái está determinado a cumplir su mission de deregulación para satisfacer las demandas del Tratado de Libre Comercio firmado con EEUU. Por lo tanto, el presidente ha emitido un decreto por el que el estado gana acceso a las tierras indígenas, las cuales son inalienables de acuerdo a la constitución de 1993 (ver el artículo de más abajo). El actual gobierno de izquierdas de Ecuador, aunque ha descartado cualquier posibilidad de establecer un Tratado de Libre Comercio con EEUU, ha dado un paso atrás con respecto al Convenio 169 de la OIT aprobado en 1998, emitiendo el decreto 1040 que restringe claramente la participación de los pueblos indígenas en cualquier medida administrative o legislativa que les afecte <strong>(ver artículo en la sección de Resistencia <a href="http://redamazon.wordpress.com/resistance/#comment-163" target="_blank">aquí</a>).</strong></p>
<p>La guera incivil de García<br />
Diario La Primera, 20 de mayo de 2008.- El Decreto Legislativo 1015 que ordena liquidar la comunidad campesina en el Perú es antidemocrático, puesto que no ha sido consultado con los comuneros; antisocial, puesto que propicia la creación de latifundios, sobre todo extranjeros; e inconstitucional, ya que viola los artículos 88 y 89 de la Carta.<br />
Con descaro, dicho decreto, publicado ayer en El Peruano, comienza precisando que se dicta para la “implementación del Acuerdo de Promoción Comercial Perú-Estados Unidos”. Es decir, el TLC.<br />
Confesión de parte. El punto aclara qué intereses (u órdenes) son los que inspiran la serie sobre “El síndrome del perro del hortelano” que el presidente Alan García ha publicado a lo largo de meses en El Comercio.<br />
El primer artículo, publicado el 28 de octubre del 2007, declaró la guerra a las comunidades. La tierra de éstas, decía, “vendida en grandes lotes traería tecnología de la que se beneficiaría también el comunero”. (Que ya no sería comunero, sino peón de un hacendado, a lo mejor chileno, o de una gran minera).<br />
Lo previmos enseguida. Y denunciamos la ignorancia de García, quien afirmó en ese texto que las comunidades eran creación del virrey Toledo. No sabe que esas instituciones provienen en gran parte del ayllu prehispánico.<br />
Una sola pregunta basta para desvelar la intención del decreto legislativo: ¿Quiénes son los que pueden comprar esos grandes lotes que promete García?<br />
Lo más probable es que detrás de los artículos y del decreto estén algunas grandes compañías mineras, cuya acción de envenenamiento de aguas y contaminación ambiental que amenaza vidas ha sido resistida por las comunidades.<br />
El proyecto viola, sin vergüenza, el artículo 88 de la Constitución, el cual establece que el Estado “garantiza el derecho de propiedad sobre la tierra, en forma privada o comunal o en cualquier otra forma asociativa.”<br />
El decreto viola también el artículo 89 de la Constitución, que declara que las comunidades campesinas y las nativas “son autónomas en su organización, en el trabajo comunal y en el uso y la libre disposición de sus tierras”. La propiedad de sus tierras, prosigue el dispositivo constitucional, “es imprescriptible.”<br />
En el inciso b) del decreto legislativo está la clave del crimen: la adquisición en propiedad de tierras comunales por terceros requerirá el voto a favor de no menos del cincuenta por ciento de los asistentes a una asamblea.<br />
De acuerdo con eso, un 25% de los comuneros reunidos en una asamblea, a lo mejor amañada, puede decidir la venta de todas las tierras de la comunidad.<br />
¿Por qué García no establece la misma regla para toda clase de empresas y sociedades?<br />
La declaratoria de guerra contra las comunidades de la sierra y la selva desatará sin duda la ira y la lucha campesina. Será un caso de legítima defensa.</p>
